We have seen that when the Deputy Minister of Transport wrote to the Ministry of Finance on 8th July 2015, to pay GHS3,649,044.75 to Smarttys, declaring that “the rebranding… has been completed,” there was no contract and there was no Public Procurement Authority approval.
One would have expected that the absence of these critical legal documents would be the first-line objection that the Ministry of Finance would raise to the rather strange and definitely illegal request to pay Smarttys.
But the Ministry of Finance (the guardians of the public purse) did no such thing. They willy-nilly approved of the illegal request for payment on 23rd July 2015, still with no contract or PPA approval.
Why would the Ministry of Finance, in a letter signed by no less a person than the Director of Budget on behalf of the Minister, approve payment for a transaction in respect of which there was neither a contract nor PPA approval?
